1. Agreement to Terms

By accessing or using the Zeaspark platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Zeaspark.

2. Description of Service

Zeaspark provides a Generative Engine Optimization (GEO) platform that allows users to monitor, analyze, and optimize their brand visibility across AI-powered search engines. The Service includes tools for brand monitoring (Lens), content optimization (Studio), and product feed management (Signal).

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. User Obligations

When using the Service, you agree to:

• Use the Service only for lawful purposes.
• Not attempt to gain unauthorized access to any part of the Service.
• Not use the Service to infringe on the rights of others.
• Not interfere with or disrupt the Service or its infrastructure.
• Not use automated means to access the Service except through our provided APIs.
• Comply with all applicable laws and regulations.

5. Subscription and Billing

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees. Fees are billed in advance on a monthly or annual basis, depending on your chosen plan. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.

We reserve the right to modify our pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle.

6. Free Trial

We may offer free trial periods for paid plans. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expires. We will notify you before the trial ends.

7. Intellectual Property

The Service, including its software, design, content, and documentation, is owned by Zeaspark and protected by intellectual property laws. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Zeaspark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the total amount paid by you to Zeaspark in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law provisions. Any disputes arising from these Terms shall be submitted to the competent courts of the Netherlands.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
